Chris Brown Breaking Out Of Jail? Petitions Assault Charges To Be Dropped

Star is due to go to trial for Washington D.C. assault in April

Chris Brown's lawyers are working on getting the star out of jail and have this week filed a petition for the Washington D.C. misdemeanor assault charges to be dismissed, claiming the prosecution acted "unlawfully" in their preparation for trial.

The 25 year-old is currently being held at the Los Angeles County Jail after his probation was revoked in December due to the Washington charges. If he's found guilty in the April 17 trial a judge could well rule he's violated his 2009 felony parole, which could see him facing a four year jail term.

On Wednesday his lawyer Mark Geragos requested the case was dropped in a petition to the Washington court after he claimed the prosecution "unlawfully got a sneak peek of witnesses," TMZ reports.

The site claims Geragos doesn't feel prosecutors had a right to take the case before a grand jury, as it had already been reduced from felony to misdemeanor charges by the US attorney general.

The petition alleges they only did so to see how their witnesses in the case would behave while under oath ahead of the actual trial in April, claiming it was an abuse of power on the side of the prosecutors.

Chris Brown and his bodyguard were both arrested in October after allegedly punching a man at around 4am outside of the Washington Hotel where the star's tour bus was parked. After being arrested on charges of felony assault, they were later reduced to misdemeanor, TMZ claims law enforcement sources told them, due to conflicting statements by witnesses and the fact the victim's injuries weren't as severe as first believed.

Following the trial on April 17, Chris will face a hearing in Los Angeles on April 23 over his parole. Currently he's in jail after initally being placed in rehab by the judge in his case, however he was thrown out of the Malibu facility earlier this month for violating three fundemental rules of his stay there.
