Lindsay Lohan was arrested and charged with assault after reportedly punching Tiffany Eve Mitchell in a New York club earlyThursday morning, but claims she was "intoxicated" at the time have been denied by her lawyer, Mark Heller.
Mark Heller stringently denied the 'Liz & Dick' star, who has had a long struggle with addiction issues, was under any "influence" at the time of the incident and has said that she was entirely lucid when he met her the next morning.
He told E! News, “She was certainly not intoxicated, certainly not under the influence of drugs. She was clear [and] lucid, her eyes were clear. No alcohol involvement whatsoever on this occasion.”
The denial comes following TMZ's claims that she had been drinking, they reported: “As for the Thursday morning NYC nightclub brawl ... we're told Lindsay was drinking all day and showed up at the Bieber concert already hammered.”

Her lawyer is however confident that she is completely innocent and will be cleared of the third degree assault charges.
He went on: "We are going to be working very earnestly to establish that no charges should even be lodged".
While police are yet to watch any video footage from the club, Heller is hoping when they do it “will reveal some exonerating information. After that, they could just walk away from the case and decline to even prosecute.”
